 The purpose of these administrative rules is to implement Chapter 103F of the Hawaii Revised Statutes (HRS), and to establish operating procedures for State agencies purchasing health and human services.  Chapter 103F provides the structural framework while these rules address the requirements and procedures to govern the basic planning activities, procuring and contracting for health and human services.

There are longstanding concerns surrounding purchases of health and human services.  The various practices and standards applied by State agencies have created inconsistencies, and at times, resulted in a difficult process for applicants, private providers and state employees.  During the past decade and a half, Chapters 42 and 42D, HRS, the predecessors of Chapter 103F, largely addressed the procedures for the submission and review of requests for grants, subsidies and purchases of service.  Those chapters were not established to be comprehensive or exclusively for purchases of service and did not contain a deliberate procurement emphasis.

Chapter 103F establishes an improved process and was designed to standardize the State's process of disbursing funds for health and human services by providing a single public procurement policy that will promote greater fairness, efficiency, effectiveness and accountability.

State agencies and private providers have indicated a desire for uniform rules that prevent the arbitrary application of different requirements and procedures among similarly situated applicants or service providers.  These administrative rules are a deliberate attempt to establish an equal foundation for all participants while allowing State agencies reasonable flexibility.
